Neither same-sex marriage nor same-sex civil union is recognised under Myanmar law.<\/p>

Same sex individuals who go through a marriage ceremony, with the knowledge that they cannot be lawfully married, may be charged under the Penal Code and subject to imprisonment and a fine.2<\/sup><\/strong><\/p>

The Penal Code criminalizes sexual intercourse that is \u201cagainst the order of nature,\u201d even between consenting adults. The term \u201cagainst the order of nature\u201d3 <\/sup><\/strong>\u00a0is not defined under the Penal Code.<\/p>

The law has been discriminatorily applied to same sex sexual activities. Since this law is cognizable, a police officer does not need a warrant to arrest a person under this law.<\/p>

Rape can only be carried out by a male against a female victim under the Penal Code. The current law does not protect men who experience similar abuse.4<\/sup><\/strong><\/p>"},{"section_id":"1723559393613-cd3959c7-0a77","section_title":"\u101b\u1032\u1021\u1000\u103a\u1025\u1015\u1012\u1031","content":"

There are provisions of the Police Act (1945) that have been used in cases of misconduct by police to harass and extort money specifically from LGBTQI persons.<\/p>

This law currently provides for warrantless arrest of any person who is disguised in some manner, between sunset and sunrise, and is unable to give a satisfactory account of his or her presence.5<\/sup><\/strong><\/p>

Public nuisance and obscenity related laws are not clearly defined and therefore leave LGBTQI persons vulnerable to discriminatory or arbitrary police action.<\/p>

The Penal Code allows the police to arrest a person without a warrant for committing an ongoing public nuisance.7 <\/sup><\/strong>\u00a0The sale, distribution, public exhibition, or mere possession of \u201cobscene\u201d materials is illegal.8<\/sup><\/strong><\/p>"},{"section_id":"1723559622511-5c46b51b-14c8","section_title":"\u101e\u1004\u103a\u1038\u1000\u103d\u1015\u103a\u1001\u103c\u1004\u103a\u1038","content":"

In addition to the laws and lack of protections that affect other members of the LGBTQI community, some transgender persons may face additional discriminatory treatment due to a legal provision against \u201cemasculation\u201d in Myanmar.<\/p>

Doctors involved in sex reassignment surgery, which in this case refers to the surgical process of removing male genitals, may be charged with \u201cemasculation,\u201d a type of grievous harm under
