To privately discuss with a lawyer while in detention and within 24 hours of arrest.2 Prisons Act, \u00a740; Police Manual para. 74(c)<\/strong><\/sup><\/p>\n

To have a lawyer provided if you cannot afford one at the commencement of trial proceedings and post-trial stages.\u00a03 2021 Law Amending the 2016 Legal Aid Law Section 2(b)<\/strong><\/sup><\/p>\n

Police officers should provide a receipt for seized items (search form).8 Code of Criminal Procedure \u00a7 103.<\/strong> <\/sup>\u00a0This form may be used as evidence against the accused in court.<\/p>\n

Detention, bail, and mistreatment<\/b><\/h3>\n

\nDetention<\/b><\/h5>\n

The accused must be brought before a judge within 24 hours.15<\/strong> Constitution (2008) Art. 376<\/strong><\/sup><\/p>\n

Children (under 18 years of age at the time of the alleged offence\/s) have additional rights and safeguards,16<\/strong> (Child Right Law 2019 Section 80 <\/strong><\/sup>including the right to be transferred to juvenile court immediately.\u00a017 (Child Right Law 2019 Section 19)<\/sup><\/strong><\/p>\n

Indefinite detention is prohibited.<\/p>\n

For non-cognizable offences, the accused generally cannot be detained beyond 24 hours.<\/p>\n

For cognizable offences, the accused is entitled to appear before a judge and make a case for release in a remand hearing.18 (Courts Manual Para 403(1))<\/sup><\/strong>\u00a0They may be detained up to 15 or 30 days (depending on alleged offence\/s) while police investigate.\u00a019 (Code of Criminal Procedure \u00a7167; Code of Criminal Procedure \u00a7167(2))<\/sup><\/strong><\/p>\n

Mistreatment in police custody<\/b><\/h5>\n

Police officers cannot harm detainees, or allow detainees to be harmed, while in custody.\u00a020 (Myanmar Police Force Maintenance of Discipline Law (1995) (amended 1997) 17(c); Constitution (2008) Art. 44; Penal Code \u00a7330; \u00a7331)<\/sup><\/strong><\/p>\n

It is a criminal offence for a police officer to harm a detainee during an official interrogation to gain a confession or information.21 (Myanmar Police Force Maintenance of Discipline Law (1995) (amended 1997) 17(c); Constitution (2008) Art. 44; Penal Code \u00a7330; \u00a7331)<\/sup><\/strong><\/p>\n

Bail<\/b><\/h5>\n

The accused has the right to bail22 (Police Manual para. 1785)<\/sup>\u00a0<\/strong>The alleged offence may be bailable or non-bailable.<\/p>\n\n\n\n\n\n\n

    Right to be presumed innocent<\/b><\/h5>\n

    The accused has the right to be presumed innocent until the prosecution proves with evidence every element of the offence\/s charged beyond a reasonable doubt.<\/p>\n

    Right to defence27 (Constitution (2008) Art. 19(c); Art. 375)<\/sup><\/strong><\/h5>\n

    The accused has the right to be informed of the charges.\u00a028 (Code of Criminal Procedure \u00a7 210)<\/sup><\/strong><\/p>\n

    The accused has the right to examine witnesses and other evidence brought against them in court.29 (Code of Criminal Procedure \u00a7 208 (2))<\/sup><\/strong><\/p>\n

    The accused has the right to offer evidence on their own behalf.30 (Code of Criminal Procedure \u00a7 298; \u00a7290; \u00a7342)<\/sup><\/strong><\/p>\n

    The accused is not required to testify as a witness31 (Code of Criminal Procedure \u00a7 342(1)(a))<\/sup><\/strong>\u00a0although they may be questioned by the judge at different stages of the trial.\u00a032 (Code of Criminal Procedure \u00a7 342(2))<\/sup><\/strong><\/p>\n

    Adequate time and facilities<\/b><\/h5>\n

    The accused must be given sufficient time and facilities to prepare a defence.33 (Constitution (2008) Art. 19(c); Art. 375)<\/sup><\/strong><\/p>\n

    This includes a right to an interpreter34 (Code of Criminal Procedure \u00a7 361)<\/sup>\u00a0<\/strong>and access to the necessary documents and evidence for trial.<\/p>\n

    Fair and impartial hearing<\/b><\/h5>\n

    The accused has the right to a fair and impartial hearing.35 (Constitution (2008) Art. 347)<\/sup><\/strong><\/p>\n

    Judicial decisions must be based on the law and facts of the case, without bias or prejudice.36 (The Code of Judicial Ethics for Myanmar Judges (2017) Art. 1-4.)<\/sup><\/strong><\/p>\n

    The presiding judge must be present at every hearing.37 (Courts Manual para. 13)<\/sup><\/strong><\/p>\n

    The judge, law officer and all public officials in court proceedings, cannot accept gifts or other items of value from anyone involved in the case.38 (The Code of Judicial Ethics for Myanmar Judges (2017) Art. 1-4; Anti\u2010Corruption Law (2013) (amended 2016 and 2017))<\/sup><\/strong><\/p>\n

    Right to a speedy trial<\/b><\/h5>\n

    The accused should be tried as early as possible while also ensuring a fair proceeding.\u00a039 (Courts Manual para. 466; para. 42)<\/sup><\/strong><\/p>\n

    Unjustifiable delay of trial proceedings is prohibited.40 (Courts Manual para. 24, para. 466)<\/sup><\/strong>\u00a0Judges should avoid frequent adjournments.\u00a0\u00a041 (Code of Criminal Procedure \u00a7344 (1))<\/sup><\/strong><\/p>\n

    Right to a public trial<\/b><\/h5>\n

    Trial should be in a courtroom open to the public except in specific cases such as in juvenile court.\u00a042 (Code of Criminal Procedure \u00a7352; Constitution Article 19(b) Child Rights Law (2019) Section 84(b))<\/sup><\/strong><\/p>\n

    Judgment and appeal<\/b><\/h5>\n

    The judgment must be delivered in open court.\u00a043 (Code of Criminal Procedure \u00a7366(a))<\/sup><\/strong><\/p>\n

    Police officers must not threaten or maltreat a child during arrest.52 (Child Rights Law (2019) \u00a780(c)) <\/sup><\/strong>The child\u2019s guardian or parent must be informed of the arrest immediately.53 (Child Rights Law (2019) \u00a780(g)) <\/sup><\/strong>The parents, guardians, relatives and lawyer of the child shall be allowed to meet with the child.54 (Child Rights Law (2019) \u00a780(g))<\/sup><\/strong><\/p>\n

    Transport, detention, and bail\u00a0<\/b><\/h5>\n

    A child cannot be detained or transported together with an adult prisoner.55 (Child Rights Law (2019) \u00a780(f))<\/sup><\/strong>
    \nFemale children should be supervised by female prison staff.56 (Child Rights law (2019) \u00a780(f))<\/sup><\/strong>
    \nChildren shall not be held in police custody or prison.57 (Child Rights Law (2019) \u00a780(e); \u00a783(e))<\/sup><\/strong>
    \nWhere possible children shall be released to their parent(s) or guardian(s).58 (Child Rights Law (2019) \u00a783(c)-(d))<\/sup><\/strong>

    Court proceedings<\/b><\/h5>\n

    If the diversion process is not taken, then the child shall be sent to juvenile court without delay.61 (Child Rights Law (2019) \u00a780(i))<\/sup><\/strong><\/p>\n

    The juvenile court proceedings shall be conducted in a separate court or building from adult proceedings.62 (\u1042\u1040\u1041\u1049 \u1000\u101c\u1031\u1038\u101e\u1030\u1004\u101a\u103a\u1025\u1015\u1012\u1031\u1015\u102f\u1012\u103a\u1019 \u1048\u1044(\u1001)\u104b)<\/sup><\/strong><\/p>\n

    Juvenile proceedings must be heard promptly.63 (Child Rights Law (2019) \u00a784f())<\/sup><\/strong><\/p>\n

    Juvenile court hearings must prioritise the best interests of the child in fairly adjudicating the case.64 (Child Rights Law (2019) \u00a783(d))<\/sup><\/strong><\/p>\n

    \u00a0<\/p>\n

    The court shall allow parents or other suitable persons to make applications and statements as part of the accused child\u2019s defence on her or her behalf.65 (Child Rights Law (2019) \u00a784(c))<\/sup><\/strong><\/p>\n

    Juvenile court proceedings are not open to the public. The court shall allow parents, guardians, relatives, and those concerned with the case proceedings, such as witnesses and court staff. The judge has discretion to allow other individuals to attend court proceedings.66 (Child Rights Law (2019) \u00a784(b))<\/sup><\/strong><\/p>\n

    The court shall not allow information on juvenile cases to be reported in the media except in the best interest of the accused child.67 (Child Rights Law (2019) \u00a785(b))<\/sup><\/strong><\/p>\n

    Child victims and witnesses also have special protections under the law, including the right to privacy.68 (Child Rights Law (2019) \u00a796(a)-(e))<\/sup><\/strong><\/p>\n

    Sentencing<\/b><\/h5>\n

    If a child is found guilty of a criminal offence, the judge shall make a ruling aimed at serving the best interests of the child and reforming his or her character.69 (Child Rights Law (2019) \u00a787)<\/sup><\/strong><\/p>\n

    The judge must take special consideration of age, character of the youth, his or her physical and mental condition and other circumstances during sentencing.70 (Child Rights Law (2019) \u00a7 87(a)-(f))<\/sup><\/strong><\/p>\n

    The juvenile court shall not impose a prison sentence normally.71 (Child Rights Law (2019) \u00a7 88 (a))<\/sup><\/strong><\/p>\n

    Diversion<\/h5>\n

    Several factors may determine eligibility for the diversion process. These include the nature of the alleged offence, age, mental development and maturity, history of criminal convictions, and whether or not the child poses a safety threat to the community.73 (Child Rights Law (2019) \u00a73(n); \u00a771(a)(i)-(vii))<\/sup><\/strong><\/p>\n

    \u00a0<\/p>\n

    The diversion process may include various actions intended to encourage rehabilitation of the accused child, this may include admonishment, victim compensation, counseling, working for social services for the benefit of the local community.74 (Child Rights Law (2019) \u00a775(b)(i)-(ix).)<\/sup><\/strong><\/p>\n

    The diversion programme may also involve the removal of the child from custody of his or her parents into a temporary home or alternate care facility if that is in the best interest of the child.75 (Child Rights Law (2019) \u00a775(b)(vii))<\/sup><\/strong><\/p>\n

    If the diversion process is not taken, then the child shall be sent to juvenile court without delay.76 (Child Rights Law (2019) \u00a780(i))<\/sup><\/strong><\/p>\n
